Question: If a teacher is sent somewhere on behalf of the Madrasa by the expense of the Madrasa, and after going there, a person gives a gift to that teacher, So is there any prohibition from the Shari’ah point of view for him to accept that gift?

Answer:
باسمه سبحانه وتعالى، الجواب وبالله التوفيق
A teacher who is sent somewhere on behalf of the Madrasa by the expense of the Madrasa, he can only accept a gift from a person with whom he has a personal relationship in the past, or from whom he has already given a gift, or from whom it is certain that he is giving that gift on the basis of a personal relationship; Not for the sake of the madrasa. Then there is no prohibition for him to accept the gift. Besides, it is not permissible to accept someone else’s gift, if someone does, he should give that to the madrasa authority. [Fatawa Qasimiyah 11/197]

عن أبي حميد الساعدي رضـ قال: استعمل النبي صلى الله عليه وسلم رجلا من الأزد، يقال له ابن اللتبية على الصدقات، فلما قدم قال: هذا لكم وهذا لي، قال: فهلا جلس في بيت أبيه أو أمه فينظر أيهدى له أم لا؟  الحديث.  بخاري، كتاب الهدية: 2525
قال صاحب تكملة فتح الملهم في شرح هذا الحديث : ودل الحديث على أن العامل لا يجوز له قبول الهدية أثناء عمله إلا ممن كان يهدي إليه قبل أن يتول العمل….. أما من تبين منه أنه لا يهدي إليه إلا حبا لذاته ولايبتغي بذلك إلا وجه الله فالظاهر أنه لايدخل في وعيد هذا الحديث إن شاء الله.
